By participating in classes at UNDRGRND Movement, you agree to these terms. Please read this document carefully before booking or attending any class.

Acceptance of Terms

By booking a class, attending a session, or otherwise using the services of UNDRGRND Movement, you confirm that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and UNDRGRND Movement.

If you do not agree with any part of these terms, please do not book or attend classes. Your continued use of our services following any update to these terms constitutes acceptance of the revised terms.

These terms apply to all participants, including adults attending in their own right and parents or guardians booking on behalf of minors. Where a parent or guardian books on behalf of a child, the parent or guardian accepts these terms on behalf of themselves and the child.

Important: These terms may be updated from time to time. We recommend reviewing this page before each new enrolment period. The "Last Updated" date at the top of this page indicates when the terms were most recently revised.

Participation Waiver

By participating in classes at UNDRGRND Movement, you acknowledge that physical activity involves inherent risks. You agree to follow all safety instructions provided by instructors and to practice within your own limits. UNDRGRND Movement, its instructors, and staff are not liable for any injuries sustained during participation in classes or use of facilities.

By booking or attending any class, you additionally confirm and agree to the following:

  • I confirm that I am physically able to participate in the class I have booked and that I have no medical condition that would prevent safe participation without prior clearance.
  • I will inform my instructor of any existing injuries, medical conditions, or physical limitations before the class begins.
  • I understand that movement training, including dance, pole fitness, yoga, and aerial arts, carries inherent physical risk, including the risk of injury.
  • I participate at my own risk and accept full responsibility for my own safety during classes.
  • I release UNDRGRND Movement, its instructors, and its staff from any liability for injury, loss, or damage sustained during participation in classes or use of studio facilities, to the extent permitted by law.

Note: Nothing in this waiver excludes, restricts, or modifies any rights you may have under the Australian Consumer Law, including any guarantees that cannot be excluded by law.

Medical Clearance Requirements

Medical clearance from your healthcare provider is required before participating in Recovery Movement classes. By booking this class, you confirm that you have obtained appropriate medical clearance and that your healthcare provider has approved your participation in physical movement activities.

The following requirements apply to all participants in Recovery Movement classes:

  • Written clearance required: Medical clearance must be provided in writing from a registered General Practitioner (GP) or specialist.
  • Currency of clearance: The clearance document must be dated within the three months prior to your first Recovery Movement class.
  • Documentation at first class: You must bring your written clearance documentation to your first Recovery Movement class. Digital copies are accepted.
  • Right to refuse entry: UNDRGRND Movement instructors reserve the right to refuse entry to any Recovery Movement class where appropriate medical clearance has not been provided or cannot be verified.

If you are unsure whether you require medical clearance for any class, please contact us before booking. We are happy to discuss your circumstances and help you find the most appropriate class for your current health status.

General Disclaimer

All classes at UNDRGRND Movement are conducted by qualified instructors. Participants engage in physical activities at their own risk. Please inform your instructor of any injuries, medical conditions, or physical limitations before class. We recommend consulting with your healthcare provider before beginning any new exercise program.

UNDRGRND Movement makes every reasonable effort to ensure that classes are conducted safely and by appropriately qualified instructors. However, we cannot guarantee that participation in any class will be free from risk of injury. All participants are encouraged to exercise personal judgement and to communicate openly with instructors about their physical condition before and during classes.

Booking and Cancellation Policies

The following policies apply to all class bookings at UNDRGRND Movement:

  • Bookings: Classes may be booked through our online booking system or by contacting the studio directly by phone or email.
  • Cancellation notice: A minimum of 24 hours' notice is required to cancel a booking and receive a class credit. Cancellations made with less than 24 hours' notice will not receive a credit.
  • Late cancellations: Cancellations made within 24 hours of the class start time will be treated as a no-show and no credit will be issued.
  • No-shows: Participants who do not attend a booked class without prior cancellation will be charged the full class amount.
  • Class pack validity: Class packs are valid for three months from the date of purchase. Unused classes will expire at the end of the validity period.
  • Refunds: No refunds are available on class packs or memberships once purchased. This does not affect any rights you may have under the Australian Consumer Law.
  • Make-up classes: Make-up classes are available within the validity period of your class pack, subject to class availability.

Australian Consumer Law: Nothing in these cancellation policies excludes any consumer guarantees or rights you may have under the Australian Consumer Law, including any right to a refund where a service is not provided as agreed.

Code of Conduct

UNDRGRND Movement is committed to maintaining a safe, respectful, and inclusive environment for all participants and staff. All participants are expected to adhere to the following code of conduct:

  • Respect: Treat instructors, staff, and fellow students with respect at all times. Disrespectful or disruptive behaviour will not be tolerated.
  • Punctuality: Please arrive on time for all classes. For your first class, we ask that you arrive at least 10 minutes early to complete any required paperwork and receive an orientation.
  • Appropriate attire: Wear appropriate attire for the class type as advised by your instructor. Specific clothing requirements are listed on individual program pages.
  • Photography and video: No photography or video recording of other participants or instructors is permitted without prior written permission from UNDRGRND Movement and the individuals concerned.
  • Alcohol and drugs: Participation in classes under the influence of alcohol or drugs is strictly prohibited and will result in immediate removal from the class.
  • Studio rules and safety: Follow all studio rules and safety protocols as directed by instructors. This includes equipment handling, warm-up requirements, and movement boundaries.
  • Harassment: Harassment, bullying, or inappropriate behaviour of any kind will result in immediate removal from the class and may result in permanent exclusion from UNDRGRND Movement.

Intellectual Property

All content created by UNDRGRND Movement, including but not limited to class choreography, teaching materials, training programmes, website content, and marketing materials, is the intellectual property of UNDRGRND Movement and is protected by Australian copyright law.

  • No recording or reproduction: Recording, reproducing, distributing, or publishing any class content, choreography, or teaching materials without prior written permission from UNDRGRND Movement is strictly prohibited.
  • Trademark: The UNDRGRND Movement name, logo, and associated branding are the property of UNDRGRND Movement. Unauthorised use of these marks is prohibited.
  • Personal use only: Any materials provided to participants for personal use (such as practice notes or programme guides) are for personal, non-commercial use only and may not be shared or reproduced.

Limitation of Liability

To the extent permitted by law, UNDRGRND Movement's liability is limited as follows:

  • Personal injury: UNDRGRND Movement is not liable for any personal injury sustained during participation in classes or use of studio facilities, except where such injury results from the gross negligence or wilful misconduct of UNDRGRND Movement or its instructors.
  • Personal property: UNDRGRND Movement is not liable for the loss, theft, or damage of any personal property brought to the studio or to any outdoor class location.
  • Cancelled classes: UNDRGRND Movement is not liable for any loss or inconvenience arising from classes cancelled due to circumstances beyond our reasonable control, including but not limited to extreme weather events, public health orders, or facility unavailability. Class credits will be provided where possible.
  • Maximum liability: Where liability cannot be excluded by law, UNDRGRND Movement's maximum liability to any participant is limited to the amount paid by that participant for the specific class or service in connection with which the liability arose.

Australian Consumer Law: Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law or any other applicable legislation.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Queensland, Australia. Any dispute arising in connection with these terms or the services of UNDRGRND Movement will be subject to the exclusive jurisdiction of the courts of Queensland.

The Australian Consumer Law, as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), applies to these terms and to all services provided by UNDRGRND Movement to consumers in Australia. Nothing in these terms is intended to exclude, restrict, or modify any right or remedy that you may have under the Australian Consumer Law.

COVID-19 and Health Policies

We maintain hygiene protocols in accordance with Queensland Health guidelines. Please do not attend class if you are unwell or experiencing COVID-19 symptoms.

The following health policies apply to all participants at all times:

  • Stay home if unwell: If you are experiencing any symptoms of illness, including but not limited to fever, cough, sore throat, or respiratory symptoms, you must not attend class. Please contact us to arrange a class credit.
  • Queensland Health guidelines: All participants are required to comply with current Queensland Health guidelines relating to communicable diseases. These guidelines may change from time to time.
  • Capacity limits: UNDRGRND Movement may implement reduced class capacity limits in response to public health requirements or studio safety considerations. Bookings will be managed accordingly.
  • Online classes: In the event that in-person classes are required to move online due to public health orders or other circumstances, participants will be notified and class credits will be provided where online participation is not possible.

Changes to Terms

UNDRGRND Movement reserves the right to modify these Terms of Service at any time. When changes are made:

  • The updated terms will be posted on this page with a new "Last Updated" date.
  • Material changes that significantly affect participant rights or obligations will be communicated to active clients via email prior to taking effect.
  • Your continued use of UNDRGRND Movement's services after updated terms have been posted constitutes your acceptance of the revised terms.

If you do not agree with any changes to these terms, you may request deletion of your account and personal information by contacting us using the details in Section 12 below.
